Risk Management and Compliance

Center for Medicare/Medicaid Services (CMS)

Upstate Medical University governs their Patients’ Rights process as outlined in CMS interpretive guidelines 482.13, entitled “Condition of Participation; Patients’ Rights”. 482.13(a)(2)(i): The hospital must establish a clearly explained procedure for the submission of a patient’s written or verbal grievance to the hospital. The department coordinates all inquiries for/by patients/families regarding Americans with Disabilities Act.

Medical Malpractice

The Risk Management Department supports the facility’s Counsel’s Office and Attorney General’s Office in all matters related to medical malpractice, including quality investigation of all Claims and review of all Notices of Intention.

Occurrence Reporting

The Risk Management Department is designated as the representative of the governing body of the Hospital to review, investigate, and file all reportable events to the Department of Health (DOH) in accordance with the Public Health Law, section 2805-I. Occurrences are tracked and trended by subtype by Risk Management

Joint Commission

The Risk Management Department coordinates organizational assignment of the National Patient Safety Goals and assesses policies and procedures to ensure compliance with standards.

Committee Support

Clinical Quality Improvement Committee (CQI)

Meeting Minutes; interfacing with Physician Advisors; preparation and distribution of citation letters, agendas, case summaries, and the meeting schedule are managed by Risk Management. Risk Management prepares an average of 2-3 cases per month for review at CQI.
